View Full Version : Help! The Commonwealth of Massachusetts is RAPING MY ANUS

theholycow

I live in RI and work in MA. MA has decided to rape me.

1. In 2008, I got a speeding ticket from a small town cop in MA.

2. The next day I talked to someone who said it would go away (yes, this sounds shady; at the time it seemed much less shady than I can describe here). I had to give the ticket to them.

3. I never heard anything. Nothing ever showed up on my record. I never received anything in the mail.

4.Today I was driving along, obeying all traffic laws, when I was pulled over.

5. I was told that my license is suspended in MA and they could arrest me, but he said he was being lenient to allow me to have my car towed out of the state.

6. I paid $170 to be towed less than 5 miles.

7. I have a citation and I'm told I'll have to wait months for them to send me a court date for an unknown date in the future.

8. I will be arrested and put in jail if I drive in MA again. I cannot go to work.

What the fuck can I do? If I had known the ticket was still valid I'd have paid it on time. If I had gotten some kind of idea that there was an unpaid ticket on my record I'd have paid it. Now what the fuck can I do?

:ffuuu:

I'd rather pay a lawyer $1000 then give $100 to MA.

Like Eddie said, try to get a temp status to go to and from work so you dont lose your job, they should allow you that atleast until it is figured out.

 When in Rome, get raped as the Romans rape. They can do what they want, it's their state. I also pay all of my state income taxes to them because that's where I work.

What an FTA warrant?

I'm sure it would have made things worse in the end but it would have been BAMF to run instead of pulling over. The VW gets up to 130mph pretty quick and it was only a few miles to the state line.

When the cop came up to my window he kept saying my name and address asking if I was him. I thought it was going to be some kind of joke that someone setup.

Potentially good news: I talked to a lawyer who looked it up in the MA computer system and said they sent notice to an old address where I haven't lived since 2002 or so. It is NOT the address that was on my license in 2008.

Update:
I went to the RMV to see a hearing officer. She was unable to actually do anything for me, but at least had some direction to offer...and some information I forgot.

Here's what I forgot: When I tried to get the ticket dismissed by the police chief, it was too late; but they said if I dispute it they would show up in court and ask for it to be dismissed. So, I signed the part saying I'd like a court date and waited.

My court date never arrived in the mail because, as I mentioned earlier, they sent it to an entirely wrong address.

Tomorrow morning I'll go to two courts and one or two RMVs. I expect to get two court dates and a temporary reinstatement of my license until one of those court dates.

stonehenge
10-07-2010, 12:29 AM
Again, wtf is RMV?

I spent the day on the same old wild goose chase.

Nobody can help. I got lots of sympathy and no help. I got documented proof that notices went to the wrong address and were returned but that's not good enough to help.

I will find out tomorrow if I can get another court date. If not I can pay $410 to get a chance at possibly getting a temporary reinstatement of my license.

stonehenge
10-08-2010, 02:11 AM
$410 for a possible chance?? :blah:

theholycow
10-08-2010, 11:18 AM
Of course they don't describe it as a possible chance, they say if I pay it then that will work, but I can hear the doubt in their voice and I know that the system is fucked up.

If I sent my payment to the wrong address and it got returned, would I be allowed the same self-righteous point of view that they take?

theholycow
10-08-2010, 07:47 PM
I think I've made some progress. The magistrate has granted me a second court date. I'll have to wait for it to come in the mail  but I'll call and pester them weekly just in case it never arrives. The clerk is faxing documents to the RMV that may allow them to temporarily reinstate my license.

I hope the new court date for the 2008 ticket comes before the appeal for the driving with a suspended license.

stonehenge
10-08-2010, 08:11 PM
If not, could you get the date for the suspended license extended? I'm sure you'd have reason to do so with the other court date coming up.

I have my temporary reinstatement. I found out on Friday about 30 seconds before I was going to give up, hang up the phone, and go home. I am driving :gB: to work. :D

I'll have a second court date for the 2008 ticket and hopefully because I've arranged for that the criminal driving with a suspended license charge will be dropped when I go to that court date.

Ok, so I finally have my day in court for the original ticket, coming up in a few weeks. I'm considering these defenses:

1. There is no posted speed limit. From the beginning of the road to miles beyond where I was ticketed, there is not a single speed limit sign.

2. Ticket specifies different car. As I understand, this is not a successful defense even if it seems reasonable. While I was going fast, the car in front of me, which matches the description on the ticket better, was also going fast.

3. I have already paid pretty thoroughly and am in financial dire straits. The ticket, IIRC, is for $240. I paid $170 to get towed, hundreds of miles worth of lease miles and gas, $100 for the suspension, and days out of work.

Anybody know more than merely how reasonable those things sound?

stonehenge
03-12-2011, 12:11 AM
Those sound pretty legit, especially the first one.

Not sure what else you could mention.

Went with "I've already paid quite thoroughly" and the magistrate agreed...it's finally over and today's $25 hearing fee was the only additional payment I had to make.

I'm getting pretty tired of getting hassled by the man.

The college where I work has teamed up with the local PD. We're paying for them to have more officers, more cars, and to take the place of what was our meager security department. Since the town doesn't have an IT department, we've been taking on some of their IT issues even when not related to the college and we're even looking at taking over 100% responsibility for their IT. They're friendly with me and just this morning two officers came to me for some help...took care of it right away for them. I wave when I see them on campus or on the road.

You'd think that with all that, they wouldn't want to bother with me unless I'm actually doing something wrong...wouldn't you?

Maybe not.

As I leave work, I get maybe 200 yards up the road when I see a police car parked on the side, obviously doing traffic enforcement. Why he didn't park further down the road where you can actually nab speeders and tailgaters (not that they'd EVER nab somebody for riding 12 inches off my bumper), I don't know. Anyway, I wave as I pass.

He enters the road behind me. I continue along my merry way, obeying the speed limits that nobody else obeys, just like I do every single day. When I'm almost to the town line he pulls me over.

I sit there, getting my registration and license out on the dash and such. Then I sit there waiting. Then finally he comes out, walks up, says he's following up on my registration, and asks if I had a Nissan before I had :gB:. Then he says I'm all set and lets me go.
:fulloffuck:

WTF Massachusetts, get your shit together. Stop fucking scanning every fucking license plate that goes by, and get your records straight. How hard can it be to keep in touch with RI's DMV?
